NSW:NSW Art Gallery director Capon retires
SYDNEY, Aug 3 AAP - Edmund Capon will retire after 33 years as the director of the
Art Gallery of NSW, it has been announced.
The 70-year-old has served as director since he was recruited from London's Victoria
and Albert Museum in 1978 by then NSW premier, Neville Wran.
"Rarely, if ever, has a single person so embodied the spirit and ambition of an institution
as has Edmund," president of the board of trustees of the gallery, Steven Lowy, said.
Mr Lowy announced Mr Capon's resignation at a press conference on Wednesday, saying
he set a goal for the gallery soon after his appointment.
"Edmund made it clear he wanted the gallery to pursue quality and not, to use his words
at the time, a broad expansion of all areas at a mediocre level," Mr Lowy said.
"As we look around the gallery today, and reflect on all that has happened under Edmund's
leadership, there can be no doubt that he has more than fulfilled that early ambition."

Experiencing a daily headache is identified as the most common form of untreated pain worldwide, and is said to cost millions of dollars in lost productivity by affecting the overall wellbeing of employees.
A loss of productivity due to headaches is estimated to affect 200,000 people daily in the UAE, and according to a recent study published by the Centre for Adaptive Disorders and Headache in Italy, four to five per cent of the global population suffer from chronic daily headaches, which can generally be treated by over-the-counter painkillers or by reducing eye strain levels.
The Ministry of Health, Ministry of Education, Health Authority of Abu Dhabi and the Emirates Medical Association have recently joined forces to launch a national awareness campaign addressing pain management. The campaign, called Relief, aims to help put an end to people suffering from daily pain, as well as raise awareness of how to improve the general wellbeing of individuals in UAE.
"Pain is often viewed as a character flaw or a weakness. But really, it's an invisible disease. You don't need to have a bandage or lose your hair to be its victim," says Thuraya Kamber Al Awadi, a spokeswoman for Relief.
"When someone is in pain - and a lot of people are - family and friends cannot always see a physical symptom such as a cut, and can tire of hearing about it, often drifting away to leave you alone to manage your pain. With pain your self- worth has a tendency to follow those people, deserting you.
"Your identity as a person can feel diminished, particularly if it affects your daily life on a regular basis. Although often treatable with over-the-counter medication or simple lifestyle changes, pain is too often ignored until it causes more serious complications."
Daily pain in UAE cuts across all genders, nationalities and ages, including an estimated 20 per cent of children. International studies have found that people are afraid to talk about it, reluctant to treat it and dismissive of its consequences on themselves and others. Relief also notes that pain in women is a common problem.
"Women are subject to kinds of pain exclusive to their sex such as, Dysmenorrhoea (menstruation pain), partum and post partum pain and chronic pelvic pain," says Professor Joseph Shokry Costandi, director of the Pain Clinic at Al Qassimi Hospital.
"They are also subjected to recurrent painful conditions such as migraine, irritable bowel syndrome and back pain." Many women, who are used to their men moaning and groaning over a simple flu, may strongly disagree, but Professor Costandi says that women are more sensitive to painful stimuli and have a lower pain and tolerance threshold.
The Relief campaign plans to educate the UAE about pain management over the next few months through public awareness events at local malls, schools and business. In the meantime, anyone suffering from pain to the extent that it is interfering with their daily life is advised to contact their local doctor immediately.

Authorities believe there's no chance any more survivors of the Christmas Island boat
disaster will be found alive.
An asylum seeker boat smashed onto the island earlier this week .. killing 30 people.
The shift from rescue to recovery mode comes as the federal government defended its
plan to set up a multi-party group to examine the tragedy .. something labelled a "talkfest"
with the opposition and independent MPs refusing to participate.
Immigration Minister Chris Bowen says there's little hope of finding anyone else alive.
It's been revealed that one asylum seeker already detained on Christmas Island lost
seven family members in the disaster.
Authorities say 42 people survived.

QLD:Man 'hit neighbour on head with hammer'

BRISBANE, Aug 10 AAP - A man hit an elderly neighbour over the head with a hammer during
an ongoing dispute, a court has been told.
Marcos De Orleans appeared in the Brisbane Magistrates Court on Tuesday morning over
the alleged attack on 77-year-old Henry James Cook.
The court was told De Orleans, 59, had assaulted Mr Cook outside his Mt Gravatt unit on Sunday.
Mr Cook had allegedly been sweeping out the front of the unit block when De Orleans
attacked him with a hammer and then bit him on the arm.
De Orlean's lawyer Kerry Smith Douglas said the alleged attack was the culmination
of a 12-month dispute between the pair.
The court was told Mr Cook was taken to hospital but the extent of his injuries were not known.
De Orleans, who has been charged with assault occasioning bodily harm whilst armed
and in company, was granted bail on Tuesday.
He was released under the conditions he reside at an address in Inala, and have no
contact with Mr Cook.
The matter will be mentioned again in September.

SYDNEY, Dec 31 AAP - Australia's New Year's Eve revellers will be out in force with
few deterred by scorching weather or persistent rain.
While rain is forecast in Queensland's southeast, organisers of Brisbane's fireworks
say it would take a cyclone to stop their display.
After Melbourne experienced a scorcher of a day, showers and possible storms are forecast
for the evening, but Acting Premier Rob Hulls said he expected the $264,000 fireworks
will go ahead.
While drizzle and grey clouds were hovering over Sydney on Thursday, weather forecasters
expect the evening will be mostly fine.
NSW premier Kristina Keneally says footage of the city's celebrations will be picked
up by 90 per cent of the world's broadcasters and watched by a potential global audience
of up to 1 billion people.
Packages of the celebrations, the centre-piece of which is a 12 minute fireworks display
at midnight, are being made available across the globe in 30 second, 60 second and five
minute packages.
The midnight fireworks display will also be beamed live to 47 Asian countries.
Thousands of the 1.5 million people expected to witness the celebrations first-hand
have been staking their claim to some of the best vantage points throughout the day.
Others camped out overnight to ensure good viewpoints.
Revellers are being encouraged to wear blue, in keeping with the celebration's title;
Awaken the Spirit, placing an emphasis on the "soul and renewal".
Many of the fireworks will be blue - despite it being one of the hardest colours to
recreate in pyrotechnics.
White will be the colour of choice in Melbourne for those attending Etihad Stadium
which is hosting Australia's largest New Year's Eve party for at least 30,000 people.
They are all due to be dressed in white and with an ocean-themed dance floor of jellyfish
and mermaids.
Despite warnings earlier this week that the fireworks centred on the Yarra River banks
would be cancelled if there was lightning, Mr Hulls expected them to go ahead.
Showers are forecast for the southeast Queensland but organisers of Brisbane's fireworks
say it would take a cyclone to stop their display.
South Bank Corporation spokeswoman Susie Johnson said laser lights would be incorporated
into the shows for the first time and would be beamed from CBD office buildings.
"It will be an absolute first," Ms Johnson told AAP.
Crews have been working for six months on the shows, which start at 8.30pm and midnight (AEST).
On the Gold Coast, fireworks displays will be held at Broadbeach and Surfers Paradise
in four shows worth $100,000.

Qld: Former MP's son appears in court on drug charge
BRISBANE, Dec 4 AAP - The son of a former Howard government minister will front court
on a charge of trafficking a dangerous drug.
Ian Kelly, 21, was allegedly trafficking ecstasy in Mackay over an 11-month period
between March 2007 and February 2008.
His mother, former frontbencher De-Anne Kelly, was the Nationals member for Dawson
for eight of those 11 months.
Kelly was one of 21 people arrested by police earlier this year as part of a covert
drug operation code-named Golf Alarm.
When Kelly faced a committal hearing in the Mackay Magistrates Court on Wednesday he
was not required to enter a plea.
He was granted bail after being charged with one count of trafficking dangerous drug.
Kelly will appear in the Mackay Supreme Court on a date after January 2009.

CANBERRA, Dec 4 AAP - Fiji's military appeared to be trying to slowly take control
of the country without mounting a coup, Foreign Minister Alexander Downer said.
Fiji troops today disarmed the island nation's only armed police unit, loading weapons
onto army vehicles at the offices of the police Tactical Response Unit (TRU) outside Suva.
There was no apparent opposition from the police.
The nation's military commander, Frank Bainimarama, has for weeks been threatening
to overthrow the government of Fiji Prime Minister Laisenia Qarase.
Earlier today Mr Downer described the situation as a stand-off between the government
and military, but during question time today, he said a coup appeared near.
"It is clear that Fiji is on the brink of a coup," he told parliament.
"This government and, I think it's fair to say this country, supports the continuation
of the democratically-elected government, we support the constitution and we support the
rule of law."
Earlier, however, Mr Downer said there appeared to be a split in the Fiji military's
ranks and it was trying to "slowly take control".
"They are now reaching a point, the military, where they are trying to persuade the
prime minister to stand down without actually mounting a coup," he told ABC radio.
"My guess is that within the military there is a fair bit of resistance to these tactics
and quite a lot of resistance to a coup.
"There isn't an inclination to mutiny against the commander, so it's a torturously
complicated situation."
Despite the tensions, Mr Downer said there were no problems for Australians in Fiji.
"We are hopeful the situation won't reach a point where they would be endangered,"
he told ABC radio.
Australia has vessels on standby to evacuate its citizens if it becomes necessary.
Mr Downer said Commodore Bainimarama had promised foreigners wouldn't be affected by a coup.
"What we can't be sure of is that there won't be some internal violence ... it is possible
and Australians could be effected collaterally but not directly targeted," he said.

Vic: Hit-run driver avoids further jail time
MELBOURNE, April 28 AAP - A driver charged over a hit-run accident that killed a 19-year-old
Victorian man has avoided further jail time.
The Victorian County Court today sentenced Michael Leslie Hore, 19, of the rural Victorian
town of Linton, to a nine-month, one-week intensive corrections order.
Andrew Wayne Knowles died about 20 metres from his Linton home, west of Melbourne,
after being struck by a car driven by Hore on April 17, 2005.
Hore, who was driving on a fake licence, later turned himself in to police.
He pleaded guilty to failing to stop, render assistance and report an accident to police.
But Judge Tony Duckett today told the court Hore's actions did not contribute to the
death of Mr Knowles, who had a blood alcohol content of 0.17 and was walking in the middle
of the road when he was hit.
The intensive corrections order means Hore will have to undertake unpaid community
service, and undergo counselling and a program of supervised rehabilitation.
Hore already has served about five months in prison on remand over the incident, which
will reduce his actual sentence by 168 days.

NSW: Faulty camera did not record driver bashing: Watkins
SYDNEY, Dec 30 AAP - The NSW government will ask for a full report into why a security
camera installed on a Sydney bus failed to record a vicious attack on the driver.
The 59-year-old State Transit driver was set upon by up to eight youths in Ashfield,
in Sydney's inner west, on Wednesday night.
He was hit with a metal pole and suffered cuts and bruising to his face and arms after
the youths flagged down the bus on Liverpool Road about 11.35pm (AEDT).
They destroyed the bus' ticketing machine and stole a small sum of money before fleeing.
NSW Transport Minister John Watkins today revealed the bus' CCTV camera failed to record
the incident.
It was reportedly not fitted properly, with a loose connection at the back of the camera.
Mr Watkins said he would seek a full report from the State Transit Authority and contractors
Chubb Security.
"I was very disappointed to learn the camera did not record the incident, and I'll
be asking State Transit why this was the case," Mr Watkins said.
"I've asked for a full report and will be seeking assurances from State Transit and
Chubb that there's no similar problem with other CCTV units in operation on our buses."
Mr Watkins said the unit was last serviced by Chubb just six days before the incident,
and had been checked three other times this month.
He said the state government was committed to improving bus security and driver safety,
with a $7.5 million plan to replace analogue CCTV with digital starting in 2006.
A 15-year-old has been arrested in relation to the incident last night but has not
been charged over the attack.

Qld: Survey to gauge Seniors' fear of crime
A survey to assess how fearful senior citizens are of crime is to take place in Queensland.
Queensland Premier PETER BEATTIE announced the $65,000 Safe and Secure survey today
at the Ballycara Retirement Village in the northern Brisbane suburb of Scarborough.
The study will asses the level of fear of crime that exists in the elderly community.
Mr BEATTIE says the last survey of this kind was conducted in 1991.
He's denied that this is a political stunt one week short of the Redcliffe and Chatsworth
by-elections.
The survey results are due at the end of the year.

Food festival to pleasure the palate and preserve the planet

SYDNEY, Aug 26 AAP - Food festivals bring out the glutton in all of us. A chance to
eat and drink the finest a region has to offer without thought for anything but tempting
the taste buds and blowing out the stomach, right? Not necessarily.
A Taste of Slow, a food festival to be held in Melbourne and regional Victoria from
August 29 to September 11, promises to be different.
The festival is being run by Slow Food in conjunction with Melbourne Food and Wine
and the Victorian government.
Slow Food, founded in 1986 when fast food giant McDonald's erected its golden arches
at the foot of Rome's Spanish Steps, is an international movement dedicated to what author
and festival guest Carl Honore calls eating well and saving the planet at the same time.
But Daniela Mollica, who heads the Melbourne chapter of Slow Food, believes people
should primarily come along to "have some fun". She hopes the message about how important
it is to preserve traditional and sustainable ways of producing, cooking and eating food
will sink in by default.
"Slow Food is about enjoying yourself with food and wine and people as a central focus.
I think the first thing is just to allow people to come along and experience the fun aspect,
and then secondarily, I hope they would walk away having had an amazing taste and wanting
to learn more about small artisan producers."
The wide range of activities on offer during the two-week event will give participants
plenty to both taste and learn. From a debate on how best to sustain Australia's river
systems and a discussion on organic food to hands-on classes with top local and international
chefs, there are hundreds of ways to experience the Slow way of eating and drinking.
And the highlights?
Mollica believes it will be a Bull-boar sausage demonstration. This half-pork, half-beef
sausage has been made by Swiss-Italians and their descendants on the Victorian goldfields
since the 1850s but is in danger of becoming extinct. She says saving the Bull-boar, and
other products like it, is part of what Slow Food is all about.
According to food writer Richard Cornish, who will run the event, the sausage is well
worth preserving not just because of its unique flavour, but because of the traditions
which surround it.
"What excites me about the sausage is that every year families get together ... to
reproduce this traditional recipe that they've done for generations. The sausage itself

O'Hare International Airport had the second-highest number of laser pointer incidents of any airport in the country in 2010, the Federal Aviation Administration announced on Wednesday.
The incidents, of people pointing lasers at aircraft, are "a serious safety issue," U.S. Transportation Secretary Ray LaHood said. "Lasers can distract and harm pilots who are working to get passengers safely to their destinations."
Overall, nationwide reports of lasers pointed at aircraft almost doubled from the previous year to more than 2,800, according to a release from the FAA. This is the highest number of laser events recorded since the FAA began keeping track in 2005.
Los Angeles International recorded the highest number of events in the country for an individual airport in 2010, with 102 reports, and the greater Los Angeles area tallied nearly twice that number, with 201 reports.
O'Hare had 98 reports. San Jose International and Phoenix each had 80.
Nationwide, laser event reports have steadily increased since the FAA created a formal reporting system in 2005 to collect information from pilots.
Reports rose from 300 in 2005 to 1,527 in 2009 and 2,836 in 2010."The FAA is actively warning people not to point high-powered lasers at aircraft because they can damage a pilot's eyes or cause temporary blindness," FAA Administrator Randy Babbitt said.
Some cities and states have laws making it illegal to shine lasers at aircraft and, in many cases, people can face federal charges.
The increase in reports is likely due to a number of factors, including the availability of inexpensive laser devices on the Internet; higher power levels that enable lasers to hit aircraft at higher altitudes; increased pilot reporting of laser strikes; and the introduction of green lasers, which are more easily seen than red lasers.

TRANSLATING FROM HOME TO WORK COMPUTER.(AT HOME)(Computers)

DEAR KEN: When I transfer work that I've done on my home computer to a diskette and then open it on my computer at work, my office computer won't recognize it. I have PFS: Windows Works at home and Microsoft Word at work. How can I get both programs to share information? - C.H.
DEAR C.H.: The problem is that the two programs save their documents in entirely different formats. To draw an analogy, the PFS document is in Latin, but Microsoft Word speaks English.
So, when you create a document at home that you'll want to work on in the office, you'll need to ''translate'' it into a format Microsoft Word understands.
Click File, choose Save As and give the document a name.
Insert a diskette into the drive, open the Drives list and select your diskette drive. Open the Save as Type list and choose the version of Microsoft Word that you have on your office PC.
Click OK, and the document will be saved to the diskette.
At work, start Word and choose Open from the File menu.
Open the Files list, choose the diskette drive and click OK.
DEAR KEN: I have a computer game called ''Shanghai'' that I can run only by exiting Windows 3.1 and typing a command at the DOS prompt. Is there a way to create a Windows icon that will start the game, instead of having to go through all that? - D.F., via the Internet
DEAR D.F.: It really depends on how ''Shanghai'' behaves in Windows. Most DOS programs have no trouble at all. Some will work only if you ''shell out'' to DOS using the DOS Command Line icon in the Main group. And others simply refuse to work at all unless you're totally out of Windows.
Let's set up an icon and see what happens:
Open the program group you want the new icon to reside in, click File and choose New.
Click the Program Item radio button and choose OK.
In the next dialog box, type a label for the icon, click the Browse button and select the file that starts the program - SHANGHAI.EXE, maybe.
Click OK and choose an icon in the ensuing dialog box. Click OK and the new icon appears in Program Manager.
Double-click the newly created icon to make sure ''Shanghai'' starts.
If it doesn't, try double-clicking the DOS Command Line icon in the Main group. This will give you the opportunity to type the DOS command required to start Shanghai. When you want to get back to Windows, type EXIT.
If ''Shanghai'' still won't work, it may be that it will function only if Windows isn't running. As a last-ditch effort, call the game's Tech Support line.

Be careful deleting in Windows 95
You probably think you're safe whenever you delete files in Windows 95. After all, they end up in the Recycle Bin and remain there until you ''empty'' it (by right-clicking its icon and choosing Empty). Until then, you can always retrieve them if you change your mind, right?
Most of the time, yes, but not always. When you delete
files from external drives (like floppy disks or network drives) they never make it to the Recycle Bin and are permanently deleted. When deleting files from these locations, you should always be extra careful by making backup copies of files you may need later.

Apple has unveiled its new portable computer, the iBook.
After the worldwide success of its colourful iMac desktop computer the company said it had responded to consumer demand for "an iMac to go".
The new iBook boasts many features found in larger desktop systems, a modem to connect to the Internet and a built-in carrying handle.
It comes in two eye-catching colours - blueberry and tangerine - and delicate parts of the case are covered in coloured rubber to protect it from bumps and knocks.
Using another new system called AirPort, the iBook can connect to the Internet without wires as long as it is fitted with a special card, and is within 150 feet of an AirPort base unit.
The basic iBook will reach US shops in September and costs the equivalent of about pounds 930. Adding the accessories needed to use AirPort will cost an additional pounds 250.
Design-wise, the iBook slightly resembles the eMate, a former Apple portable computer that earned respect for its simplicity and ease of use. Although designed for use in schools, it gained an appreciative audience among adult users, but was later discontinued.
Some eMate features, such as a curvaceous design and tough casing, have been re-born in the iBook.
The iMac personal computer will soon be a year old, and just under two million of them have been sold worldwide.
Mr Steve Jobs, chief executive officer of Apple, said that nine out of ten iMac buyers used their computers mainly for accessing the Internet. Worldwide, one in three iMacs were bought as first computers.
One of the most popular features of the iMac was its simplicity to set up.
Once lifted out of its box and placed on a table, Apple said it could be set up and connected to the Internet for the first time in under ten minutes, even by a beginner.
The instructions in the iMac box were limited to six photographs showing how to connect the keyboard and mouse to the computer, then plug it into a phone line. The final step was pressing the "on" switch.
Speaking to Apple customers at the MacExpo show in New York, where the iBook was announced, Mr Jobs said: "We asked people what they wanted, and what they said was an iMac to go, so that's what we made.
"The iBook is very beautiful, and very powerful, and it is the second fastest portable computer in the world, after our own PowerBook product.
"This finally completes our range of products. We are extremely excited about it."
A spokesman for Apple UK said he expected the iBook to be on sale in this country by the end of September, but could not say how much it would cost.
For the technically minded, the iBook boasts a 12.1 inch TFT screen, 3.2GB hard disk, 32MB RAM (expandible to 160MB), a 56KBps modem, 300MHz G3 processor, CD-Rom drive, full-sized keyboard, USB and Ethernet ports, and six-hour battery life.
Bandai to Offer Internet Service for Its Handheld Game Unit.
Bandai Co Ltd is following the lead of Nintendo Co and developing an internet access kit for its handheld game unit, the 'WonderSwan'. The kit will consist of an adapter to allow the handheld to be connected to a personal digital cellular (PDC) mobile phone and software that allows users to read e-mail, browse the web and download games from the internet. According to AsiaBizTech, the data transfer rate available with the 'WonderGate' kit will be 9,600Kb per second. Bandai is planning to launch the service at the end of this year, although mobile communications carriers, rather than Bandai, will sell the kit. Bandai has given no details of the pricing of the kit yet. Nintendo has said that it will start a similar online service for its Game Boy handheld device next year.
Bandai has tried to develop online game services before, only to get badly burned in the process. Between 1995 and 1998, the Japanese toy maker developed an internet home terminal with Apple Computer Corp called the Pippin. Although it incorporated many of the ideas now used in machines like the Sega Dreamcast and Sony Playstation 2, the terminal was not a success because it was too costly and not well supported by software. Bandai ditched the project in 1998 at a cost of $214m.

Advocate General's Opinion: Interflora Inc vs Marks & Spencer.
Does use of a keyword that corresponds to a trade mark by advertisers on an internet search engine constitute "use" of a trade mark and if so can the trade mark owner prohibit such use?
Advocate General J""skinen's (AG) opinion in relation to Interflora Inc, Interflora British Unit v Marks & Spencer PLC, Flowers Direct Online Limited C-123/09 delivered on 24 March 2011 indicates that brand owners can, in certain circumstances, prevent keyword advertising.
The opinion has been widely reported in the media and brand owners are therefore hopeful that the opinion will be followed by the European Court of Justice (ECJ). Although theAG's opinions are not binding on the ECJ they are persuasive and have reportedly been adopted in at least 80% of the cases before the full court.
The High Court of Justice (England and Wales, Chancery Division) had previously opted to stay proceedings in the matter and instead referred it to the ECJ in July 2009.
Initially ten questions were referred to the ECJ. However questions five to ten were withdrawn by the High Court following the Google France and Google judgments (joined cases C-236/08 to C-238/08). The remaining four questions were consequently divided into two groups by the AG:
Rights conferred to all trade marks under Article 5(1) of the First Council Directive 89/104 EEC (Directive) and Article 9(1)(a) of Council Regulation (EC) No. 40/94 (the regulation).
Protection of trade marks with a reputation under Article 5(2) of the Trade Marks Directive 89/109.
Both the Directive and the regulation are applicable to member states of the European Economic Community.
In his analysis, the AG states that while these questions are subject to examination in light of Article 5(1)(a) and 5(2) of the Directive, the interpretation is equally applicable to Article 9(1)(a) and (1)(c) of the regulation.
Facts
In past cases aggrieved parties have chosen to institute proceedings against Google for its sponsored link and competitor bidding practices. However in this instance, Interflora Inc instituted trade mark infringement proceedings against Marks and Spencer (M&S) directly.
The applicant, Interflora Inc, is a US corporation with a worldwide flower delivery network and is the proprietor of trade mark registrations on a global scale for the INTERFLORA mark in various classes including class 31 (plants and flowers), class 35 (advertising services), and class 39 (transportation of flowers and gifts).
The respondent is M&S a well known UK retailer offering a wide range of goods and services via its stores and its websitewww.marksandspencer.com. M&S also offers a flower delivery service and purchased keywords for Google's AdWord paid referencing service. Consequently M&S advertisements appeared under the "sponsored link" heading when internet users entered the search term "interflora" or the like on Google. Importantly the advertisements did not contain any references to the INTERFLORA mark and its services and instead offered flower delivery services from M&S Flowers online.
The purchase of the keywords purportedly coincided with Valentines Day and, being a significant day for flower trade, further prompted Interflora to institute trade mark infringement proceedings against M&S.
Article 5(1)(a) of the Directive
Article 5(1)(a) affords the exclusive right to a proprietor of a trade mark to prevent the unauthorised use of a sign that is:
Identical to a registered trade mark and used in respect of identical goods and/or services for which the mark is registered.
Similar to a registered trade mark and is used in respect of similar goods and/or services where confusion and/or association with the registered trade mark and proprietor is likely.
The interpretation of Article 5(1)(a) offered by the AG is that in instances where a keyword is identical or similar to a registered trade mark and is used in respect of identical or similar goods or services, the unauthorised party can be prohibited from doing so. The proviso is that the advertisement does not enable, "an average internet user or enables the said user only with difficulty" to determine the origin of the advertisement.
The opinion acknowledges that the Google France and Google case, the only judgment involving a search engine operator, established that the operation of a search engine or a paid referencing service does not constitute "use" of a trade mark. Instead it is the advertiser itself who both chooses and uses a keyword. While these adverts in the main do not associate the advertiser with the trade mark, and even less so when used in respect of different but somewhat related goods and services, the likelihood of confusion on the part of the internet user cannot always be excluded.
Pertinent to the AG's reasoning is that he acknowledges that the INTERFLORA trade mark is well-known for its network of flower delivery services and has therefore also gained a secondary meaning in commerce. Consequently he is of the view that the M&S Flowers online advertisements, shown when typing in the "interflora" keyword, are likely to create an association between M&S and Interflora in the mind of the average internet user.
Article 5(2) of the Directive
The questions referred to the ECJ seek clarity as to when Article 5(2), which protects against dilution of trade marks with a reputation, applies. Reference to dilution in EU law concerns the terms "blurring", "tarnishment" and "free-riding" while similar provisions in US law concern only "blurring" and "tarnishment".
Considering Davidoff v Durffee (C-292/00), the AG asserts that protection against dilution for a trade mark with a reputation extends to identical as well as similar signs, goods and/or services. Consequently the extended protection in terms of Article 5(2) of the Directive is afforded against a user of an identical or similar sign where the parties are competing commercially.
So as to address these three concepts comprising dilution and further determine whether Article 5(2) of the Directive applies to the Interflora matter, the AG maintains that as per Google France and Google, the visible outcome or sponsored link ultimately revealed to the internet user should be the starting point.
Blurring, tarnishment and free-riding
"Blurring" arises when a sign or mark is used in a manner that does not only identify the goods and/or services as belonging to one source namely the trade mark holder. Although the INTERFLORA mark risks blurring because the M&S adverts offer flower delivery services, this argument is dismissed in the opinion because the INTERFLORA mark does not appear. The AG states that the sign must both be present in the advertisement and be used in a generic manner that covers a group of goods or services generally for there to be blurring.
L'Oreal SA & Others v Bellure Nv & Others (case no.487/07) dealt with the imitation of luxury products finding that there is "tarnishment" when the use of a sign is detrimental to the mark's reputation. The advertised M&S flower services offer an alternative to Interflora, but will not necessarily negate the image of the INTERFLORA mark. Acknowledging that it is not a case about tarnishment, the opinion deals no further with this issue.
The L'Oreal judgment further states that "free-riding" occurs when an unauthorised user takes unfair advantage of a mark with a distinctive character and repute by benefitting from it, without expending any additional effort or compensating the trade mark holder for any of the benefit derived. Free-riding may be better explained as, "riding on the coat tails of the trade mark proprietor". Following this rationale the use complained of does not necessarily need to be detrimental to the trade mark proprietor.
The AG's view however is that it would be anti-competitive if a trade mark proprietor could assert its right to prohibit the unauthorised use of a sign in all instances even when the use complained of is not harmful. He states that even if the advertisement in the sponsored link contains the mark, this may still be acceptable as comparative advertising. Although M&S also offers flower delivery services there are no comparisons drawn or express references made to the INTERFLORA mark therefore no free-riding.
Implications
The opinion indicates that there are certain circumstances when trade mark proprietors may be able to prevent the use of a mark in keyword advertising. In terms of Article 5(1)(a) of the Directive, this could occur if:
there is unauthorised use of an identical or similar sign to a trade mark as a keyword and the advertisements revealed refer to the trade mark; or
the origin of the goods and/or services offered in the advertisement are not clear; or
the average internet user is likely to be misled into believing there is an association between the trade mark proprietor and advertiser.
And in terms of Article 5(2) of the Directive, this could occur if:
the keyword used is identical to a reputable trade mark and the advertisement refers to the trade mark; or
the mark is used in a generic manner (blurring) or is an attempt to take unfair advantage of the goodwill and repute associated with the mark (free-riding).
In September 2010 Google changed its AdWord policy allowing companies to use competitors' trade marks as keywords so as to display their own advertisements in search results. The ECJ ruling in the Interflora matter is expected some time this year and, if the opinion is adopted, advertisers and arguably Google, could be forced to revisit keyword advertising and sponsored link strategies.

Limitless mulling move for Minerva.

Dubai developer Limitless yesterday said it was considering a takeover offer for property company Minerva, sending the UK firm's share price soaring.
Limitless, part of state-owned conglomerate Dubai World, said in a statement it had not made a formal approach to Minerva's board and that it was in the "very preliminary stages of considering its options".
Shares in Minerva were up more than 23 per cent at 124 pence ($2.43) in morning trade as investors hoped to benefit from signs of emerging foreign investor interest in central London's battered real estate market. The price fell to 115.25 pence later in the day. Limitless released a statement saying it "notes the recent movement in Minerva's share price" and confirmed it was weighing up a bid for the company. It added that no decisions had yet been made.
"There has been no formal approach to Minerva's board and there can be no certainty that any offer will be forthcoming nor as to the terms on which any offer might be made. A further announcement will be made in due course, as appropriate," the statement added. Minerva owns two development schemes in London's City financial district and is building a major shopping centre in Croydon, on the southern tip of Greater London.

Reluctant "crown prince" Rahul Gandhi is finally getting his hands dirty in India's tumultuous political scene after years of dithering about filling the boots of his illustrious forebears. Gandhi, 38, whose father, grandmother and great-grandfather were prime ministers, has launched what the ruling Congress party has dubbed his "Discovery of India" trip - aimed at winning hearts and minds as elections loom.
"He has become the new face of the party, (representing) a new generation," said political columnist Parsa Venkateshwar Rao. Despite being a member of India's parliament, Gandhi, projected as a future prime minister, had worried party leaders with his seeming hesitation to take up his dynastic duties. But now he has waded into battle with a politician who could be his toughest foe; iconic low-caste leader Mayawati, who also wants to be prime minister.
The good news for Congress is that Gandhi, whose political appearances had been few and far between, "is finally beginning to irritate someone. The bad news is he has irritated Mayawati," noted veteran columnist MJ Akbar.
The confrontation is being played out mainly in India's most populous state Uttar Pradesh, where Mayawati is chief minister and which the Gandhi family view as their inherited political fiefdom. The charismatic Mayawati, nicknamed the "dalit queen" -A a dalit being someone on the lowest rung of India's ancient caste hierarchy - swept to power last year in Uttar Pradesh and has made no secret about wanting to be premier. "People say Uttar Pradesh is just a glimpse of what's going to unfold at the national level," she claimed in January.
With general elections due by May next year, Congress has been rattled by her meteoric rise. It has traditionally enjoyed the support of the dalits - or "untouchables" as they used to be known - once considered so impure that upper castes carried out cleansing rituals if a dalit touched them or their shadow fell upon them.
But Mayawati, who heads the regional Bahujan Samaj, or Majority People's Party, and is seeking to build a pan-India support base, is challenging Congress for low-caste loyalty. Gandhi, whose mother Sonia is party chief, has embarked on a slew of visits to humble rural homes as Congress tries to retain the vast low-caste vote.
Mayawati has lost no time accusing the shy, bespectacled Gandhi, who still looks and sounds more like an earnest student than a seasoned politician, of opportunism. Congress "is sending its prince (Gandhi) to live and eat with dalits just to win their votes", she said, accusing him of "bathing with special soap and going through purification rituals after meeting and eating with dalits".
Gandhi, dishevelled and dirty after campaigning under a baking sun, angrily dismissed the charges last weekend and demanded reporters inspect his dust-streaked shirt and trousers. "See my clothes. Do you think I use special soap?" asked Gandhi, a former business consultant elected to parliament in 2004, adding: "My job is to go and listen to those who are not heard."
While he has dismissed calls by party members for him to be the next premier, replacing scholarly 75-year-old incumbent Manmohan Singh, no-one rules him out in the longer term despite his wooden campaigning skills. The family's aura - akin years ago to the Kennedys in the United States - is so great that many in the Congress cannot picture a future without a Gandhi in charge.
"Don't be surprised if the Congress portrays him as the person to lead the country in the 21st century," said political analyst Mahesh Rangarajan. But others believe Congress may no longer be able to play the dynastic card. Mayawati "is here to stay", said Business Standard political columnist Aditi Phadnis.

Naperville mayor, 3 council members accept pay hikes.(News)

Five of the eight Naperville City Council members have pledged to forgo a 2.7 percent pay increase this year.
Mayor George Pradel and Councilmen Doug Krause, Bob Fieseler and Paul Hinterlong will accept the increase, and each says he is justified in doing so.
All eight Naperville City Council members, who make between $11,413 and $11,687 per year, are in line for a 2.7 percent increase, according to the city code, which matches pay rate with the rate of inflation for the Chicago area. In addition, the city contributes between $11,000 and $18,000 to the health care plan of six councilmen and the same six receive about $100 per month for Internet and cellphone usage.
Pradel, who makes $28,533, including his liquor commission salary, is also in line for the increase and plans to take it.
"I declined the raise last year in solidarity with the council members with hopes that others in the city would follow our example but not everyone got the message," Pradel said Wednesday afternoon.
"But I'm taking the raise this year because all I do is give, give, give to this city."
Pradel said the increase he receives will quickly be put back into the city economy.
"If there's a lunch, I pay out of my pocket. If someone else pays, I leave the tip. If there's a raffle or door prize I buy tickets," he said. "So this increase will help with that."
Krause also said Wednesday that he would be accepting the raise, bringing his salary up to about $12,000.
"Yes, I'll be taking the 85-cent per day increase," Krause said. "I've never turned in a single expense report and I use my own car for city business so I don't regret accepting the increase."
Fieseler and Hinterlong, the two council members who decline health care coverage and the $1,200 annual stipend, will also be taking the raise.
"It's disingenuous for those declining the raise to do that while taking the health care coverage," Fieseler said. "That's like saying, 'Hey, I'll take $25 a month here while I take a couple thousand a month through the back door.'"
Hinterlong agreed, calling himself his constituents' "best bang for the buck" on the city council.
"Even with the raise, I'm as cheap as they come," Hinterlong said.
Those declining the increase are Joe McElroy, Judy Brodhead, Kenn Miller, Grant Wehrli and Steve Chirico.
Chirico, who entered the position at the full salary of $11,687 because he was not on the council to decline the raise last year, said taking the increase would send the wrong message.
"We've got employees still working under the conditions of a pay freeze so there's no way I could accept the increase," Chirico said. "It's a small amount but taking it would not be the right thing to do."
Brodhead agreed, calling the move "more symbolic than anything else."
Council members had until 5 p.m. Wednesday to inform the city's finance director of their decision.

HUNDREDS of thousands of us will be making the most of this month's Bank Holiday bonanza to get away from it all.
But if you want to enjoy your Easter without a financial hangover afterwards, make sure you don't fall into those expensive holiday pitfalls...
CHECK MOBILE COSTS
IT'S easy to rack up hundreds of pounds in charges for using your mobile phone abroad, especially if you access the internet.
From last July the EU ruled that providers must put a EUR50 (pounds 44) cap on mobile broadband charges while abroad and send users a warning when they reach 80 per cent of their data-roaming bill limit.
These measures only apply to EU countries so be careful in places like Turkey and Switzerland where charges are high.
Most providers offer add-on packages to help keep call costs down. Orange has Europe Traveller for its contract customers, which costs pounds 5 for 30 days and gives 200 minutes of calls at 28p a minute compared with the usual 38p a minute, plus you can receive 200 minutes of calls for free.
MAKE SURE YOU'RE INSURED
AROUND half of Brits planning a mini-break abroad this Easter could be travelling without insurance, a survey by travel insurer Protect yourbubble.com found.
Policies start from as little as pounds 9 from Cheaper Travel Insurance which covers a family of four for a week. And if you're going to Europe, don't forget to take a European Health Insurance Card (EHIC) to get the same level of treatment as the locals.
STRANDED AT THE ROADSIDE
THE last thing you want is to be stranded miles from anywhere, so take out breakdown cover to avoid hefty garage call-out charges.
Prices start from as little as pounds 31 a year with RescueMyCar.com for policies in the UK. European breakdown cover costs pounds 54 for a 14-day policy with Direct Line.
SORT CURRENCY IN ADVANCE
BUY your travel money ahead of your trip. You will pay pounds 330 for EUR300 at some Italian airport bureaux de changes - pounds 65 more than what you would have paid in the UK.
Watch out for steep charges for using your plastic abroad too - most debit and credit cards charge a foreign usage fee of 2.75 per cent, plus a cash withdrawal fee of 1.5 per cent. Our table on the left shows some of the worst offenders.
As an alternative, use a pre-paid card to keep costs down. You can load the card with the amount you want to spend and there are no spending or foreign usage fees.
Or go for the Halifax Clarity credit card which has no foreign exchange fees and doesn't charge a fee for cash withdrawals.

IF you haven't booked your rental car yet, then act now as providers are busy hiking up prices by as much as 90 per cent ahead of the Bank Holidays.

'Debit card cost us pounds 100 in fees'
MIKE and Katherine Richards make sure they take much more care these days after being stung with charges of up to pounds 100 for using their debit card abroad.
The couple - who have three children, Emma, 10, Toby, seven, and Rebecca, five - usually take two holidays a year and are hoping to book a last-minute break somewhere in Europe this Easter.
Mike, 42, who runs a recruitment company, says: "Previously I have used my Lloyds TSB debit card to withdraw cash and pay for things on holiday, but when we got back and checked our statements we found we were forking out between pounds 50 and pounds 100 in charges over a two-week break."
The Lloyds TSB debit card has a foreign load fee of 2.99 per cent and a cash withdrawal charge of 1.5 per cent with a minimum charge of pounds 2 every time you take out money. It also charges pounds 1 every time you use it.
Now the couple, from Farnham, Surrey, use a pre-paid card with Caxton Fx, which has no spending or foreign load fees.
Mike says: "Having a pre-paid card is ideal because you know you can't overspend on it."
